Terms & Conditions Agreement
This Agreement governs your use of the American Bin Solutions, Inc. trash can cleaning service (the “Service”) and is entered into by you (the “Customer”) and American Bin Solutions, Inc. By using our Service, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement, including any additional rules, policies, pricing schedules, or supplemental documents incorporated herein by reference and updated from time to time.
1. Service Overview
Description:
American Bin Solutions, Inc. offers a trash can cleaning service through our website. The Service is provided on a recurring subscription basis. By selecting a service plan, you enroll in an automatic renewal cycle that continues on your anniversary date unless you cancel in accordance with the terms below.
Subscription Requirements:
- Monthly Plans: Require a commitment of three services before cancellation is permitted.
- Quarterly Plans: Require a commitment of two services before cancellation is permitted.
- All services must be paid in full prior to scheduling.
Billing and Payment:
Billing is handled similarly to other recurring services. You will be charged on the first day of the month in which you are scheduled for service. Charges will apply even if our service team is unable to complete the cleaning due to conditions within the Customer’s control. Refunds are not offered for such situations. In select circumstances, a one-time courtesy reschedule may be granted; however, this is not guaranteed. If external factors—such as municipal collection delays, severe weather, or road access issues— prevent service, we will notify you and reschedule your service at no extra cost.
2. Customer Responsibilities
Communication:
You will receive notifications regarding your service via email and/or SMS. To ensure you receive these communications, please add our designated email address to your approved contacts. Please note that any third-party text messaging services used for SMS notifications are not provided by Webit.com. American Bin Solutions, Inc. is solely responsible for selecting and managing the third-party provider of these text messaging services. Webit.com does not offer text messaging and bears no responsibility or liability for any SMS communications facilitated by such third-party services.
On the Day of Service:
- Placement: Ensure that your trash cans are placed at the curbside by 8:00 a.m. If
- curbside placement is not possible, bins must be clearly visible from the street and
- reasonably accessible.
- Service Hours: Our service is provided between 8:00 a.m. and 7:30 p.m.
Bin Preparation:
Each bin should either be empty or contain no more than one bag of trash not exceeding 25 lbs. We reserve the right to refuse service if any bin contains:
- More than one bag of trash or any bag weighing over 25 lbs;
- Loose or unbagged trash, yard clippings, diapers, or animal waste;
- Hazardous materials (such as chemicals, paint, glue, or adhesives);
- Cooking grease or oils poured directly into the bin;
- Building materials such as plaster, stucco, or concrete.
Rescheduling:
If your bins cannot be serviced on the scheduled day, you must notify us before 8:00 a.m. on that day. We will then reschedule your service for the next available cycle (typically the following month). If you fail to provide notice and our service team is dispatched but unable to complete the cleaning due to factors beyond our control, no refund will be provided.
3. American Bin Solutions, Inc.'s Responsibilities
If American Bin Solutions, Inc. is unable to provide the Service on the scheduled day for reasons not attributable to the Customer's actions, we may, at our sole discretion:
- Reschedule the service for the next available business day, or
- Provide a credit for the missed service.
4. Modifications to the Agreement and Service
Agreement Amendments:
American Bin Solutions, Inc. reserves the right to modify this Agreement at any time. Updates will be posted on our website and/or communicated via your registered contact information. Continued use of the Service after such updates constitutes acceptance of the revised terms.
Service Modifications:
We also reserve the right to change the manner in which our Service is delivered to improve the overall customer experience and efficiency of our service program.
5. Charges and Payment Terms
Service Charges:
You agree to pay all charges associated with your use of the Service at the rates in effect at the time of sign-up, exclusive of any applicable taxes unless otherwise required by law. American Bin Solutions, Inc. may adjust pricing or introduce new charges, and such changes will be communicated to you by telephone, email, or mail. Your continued use of the Service constitutes your acceptance of the modified pricing.
Recurring Billing:
Payment for the Service is due on your scheduled billing cycle and must be made using your designated credit or debit card. You authorize American Bin Solutions, Inc. to charge your card for each service period. If your payment method is declined or otherwise not honored, you agree to immediately settle any outstanding amounts. Repeated payment issues may result in suspension or termination of your Service without further notice.
Pre-Paid Discounts and Cancellation Charges:
For subscriptions that include a pre-paid discount for a fixed number of months, fees are payable in advance and are non-refundable except in the event of a proven relocation. If you cancel your recurring subscription within 30 days of your first cleaning, you authorize American Bin Solutions, Inc. to charge your card for the difference between the recurring service price and the published annual service price.
6. Miscellaneous Provisions
Non-Waiver:
A failure by either party to enforce any provision of this Agreement does not constitute a waiver of that right.
Assignment:
Neither party may assign or transfer any rights under this Agreement without the prior written consent of the other party.
Severability:
If any part of this Agreement is deemed illegal or unenforceable, the remainder of the Agreement will continue in full force and effect.
Force Majeure:
Neither party shall be liable for delays or failures in performance due to circumstances beyond their reasonable control (including acts of God, war, civil disturbances, or labor disputes). If such delays persist for 30 days or more, the affected party may terminate this Agreement upon written notice.
Use of Service Images:
By agreeing to these Terms and Conditions, you grant American Bin Solutions, Inc. the right to take before-and-after images of your bins, which may be used for social media and select advertising campaigns. No personally identifiable information (such as street signs, house numbers, or license plates) will be made public. To opt out of this provision, please contact us via your registered communication method.
